Medical Help USA is a VIP service provider for medical tourism patients and works closely with The American Hospital and Koc University Hospital located in Turkey (the “Treating Hospitals”). Medical Help USA does not control or operate any of the Treating Hospitals, neither does it operate or control any facility or service provided by the Treating Hospitals and/or the various physicians associated with the hospitals (the “Treating Physician(s)”) mentioned on our website. Medical Help USA takes care in selecting each and every component within the medical tourism service and has no control whatsoever in running the Treating Hospitals. Therefore, Medical Help USA cannot be held liable or responsible for any delay, default, failure, improper services, or deficiency in services provided by the Treating Hospitals and/or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever which may arise due to any act of negligence, deficiency or default in services, of the management or employees of the Treating Hospitals.
The Treating Hospitals shall be solely responsible for all treatment to be provided by it to you as the patient (the “Patient”), including but not limited to surgical, medical, wellness, beauty and all related queries, opinions and complications. Medical Help USA shall not be responsible for any of the above-mentioned treatment.
Any emergency, complication or medical requirement, of whatsoever nature, arising with regard to the Patient’s treatment due to the Patient’s present or past illness or the side effects, allergy to drugs, or lack of adequate treatment, including pre, during or post treatment, will be the absolute responsibility of the Treating Hospital and/or the Treating Physician at that Treating Hospital, as the case may be, and Medical Help USA shall not be responsible for the same.
Any medical information not disclosed or withheld by the Patient or his/her relatives, or any medical information not asked for due to the negligence of the Treating Hospital and/or the Treating Physician will be the absolute responsibility of the Patient, Treating Hospital and/or the Treating Physician, as the case may be, and Medical Help USA shall not be responsible for the same.
In case the Treating Hospital and/or the Treating Physicianis not competent in handling a particular emergency or complication arising pre, during or post treatment of the Patient, it shall be the absolute responsibility of the Treating Hospital and/or the Treating Physician, as the case may be, to refer or call upon the competent medical authority, after taking the consent of the Patient, or if applicable, his/her family members / relatives / escorts / friends (hereinafter the term “Patient” shall include all applicable authorized representatives of Patient and shall collectively be referred to as the “Patient”), and Medical Help USA shall not be responsible for the same.
It shall be the absolute responsibility of the Treating Hospital and/or the Treating Physician, as the case may be, at the time of the Patient’s admission to apprise him/her of the possibility of any supplemental expenses (howsoever rare) and secure the Patient’s consent in
writing to pay for or assist the Treating Hospital to recover from the insurance company such expenses. Medical Help USA shall not be responsible for any such supplemental expenses.
The Treating Hospital shall be solely responsible for any extension/change of treatment dates by it and/or the Treating Physician, as the case may be, and Medical Help USA shall not be responsible for the same.
The Patient shall read carefully the terms and conditions mentioned herein before signing the registration form, which shall be emailed to you upon registering at www.medicalhelpusa.com. The terms and conditions as set out in the registration form are also set out in the registration package brochure, a copy of which will be provided to the Patient upon registration. The Patient shall sign the registration form. The signing of the registration form by the Patient shall mean acceptance in totality of the terms and conditions contained herein by the Patient.(The registration form shall be binding on the Patient and shall constitute a contract between Medical Help USA and the Patient upon the Patient signing the registration form and making his/her payment to Medical Help USA.
If the Patient has any complaint in respect of the services rendered by the Treating Hospital, he/she should forward such complaints directly to the Treating Hospital without any recourse against Medical Help USA.
By using the services offered by Medical Help USA, you signify your acceptance to our terms and conditions as set forth on www.medicalhelpusa.com, and as such hereby release Medical Help USA from any and all liability resulting, whether directly or indirectly, from your treatment at any of the Treating Hospitals.
